Terms of Service
§1 Scope
(1) These Terms of Service govern all contracts between GrowthKit (provider: Anita Suk) and customers regarding the use of the GrowthKit platform, consisting of:
- the web application at app.growthkit.tools,
- the marketing website at growthkit.tools,
- the GrowthKit Chrome browser extension,
- the GrowthKit API (MCP server),
- and all related AI-powered services.
(2) GrowthKit is a Strategic Revenue Management System that provides AI-powered analysis, a persistent memory system, team collaboration, and third-party integrations (CRM, enrichment, intent data).
(3) Deviating terms and conditions of the customer shall only apply if expressly agreed in writing.
§2 Use of the Platform / Prohibited Activities
(1) Use of the platform requires that users are of legal age and have full legal capacity. The platform is intended exclusively for business users (B2B).
(2) The following activities are expressly prohibited:
- any unlawful use of the platform,
- transmission or introduction of viruses, malicious code, or automated bots,
- scraping, crawling, or automated extraction of content,
- attempts to circumvent technical security measures,
- use of the platform for redistribution or resale purposes,
- misuse of the AI assistant to generate unlawful, discriminatory, or misleading content,
- sharing access credentials or API tokens with unauthorized third parties.
(3) Violations may result in account suspension and extraordinary termination.
§3 Scope of Services
(1) GrowthKit provides a SaaS platform (Software as a Service) that supports companies in strategic revenue management. Core features include:
- AI-powered assistant for strategy, pipeline, and revenue management,
- persistent memory system with semantic search and chapter-based organization,
- Chrome browser extension for context-aware usage,
- team collaboration with role-based access,
- integrations with CRM systems (e.g. Pipedrive), enrichment services, and intent signal providers (e.g. Dreamdata),
- document upload and AI-powered extraction.
(2) AI-generated content is created with care but without any guarantee of completeness, accuracy, or fitness for a particular commercial purpose.
(3) The specific scope of services depends on the selected plan (Free / Growth / Scale).
(4) No particular business outcome is guaranteed.
§4 Contract Formation and Account Creation
(1) The contract is formed upon registration on the platform. For paid plans, the contract becomes effective upon successful payment via Stripe.
(2) Access to the platform is granted immediately upon registration (Free plan) or upon successful payment (paid plans).
(3) Each user may create only one account. Multiple registrations to circumvent plan limits are prohibited.
§5 Plans, Pricing, and Changes
(1) GrowthKit is offered in the following plans:
- Free: Limited feature set (limited number of memories, restricted chapters),
- Growth: Extended feature set for growing teams,
- Scale: Full feature set for larger organizations.
(2) All prices are stated in Euros. Applicable VAT is shown in accordance with statutory requirements.
(3) Payments are processed via Stripe. Depending on the plan, monthly or annual billing cycles are available.
(4) The provider may adjust prices and feature scope for future billing periods. Existing customers will be notified at least 30 days before any changes take effect. In the event of a price increase, customers have the right to cancel at the date the change takes effect.
(5) The provider reserves the right to reject or cancel orders in cases of incorrect information or technical issues.
§6 Subscription, Cancellation, and Right of Withdrawal
(1) Paid plans are concluded as subscriptions and renew automatically for the respective billing period unless cancelled in a timely manner.
(2) Cancellation is possible at any time, effective at the end of the current billing period. Cancellation can be made via the web application or by email to [email protected].
(3) After cancellation, access remains active until the end of the paid period. Afterwards, the account is downgraded to the Free plan.
(4) Right of withdrawal for consumers: As GrowthKit is intended exclusively for business customers (B2B), no consumer right of withdrawal applies in general. Should a consumer contract exist in exceptional cases, the statutory withdrawal period of 14 days applies.
(5) The right to extraordinary termination for cause remains unaffected for both parties.
§7 Usage Rights and Intellectual Property
(1) Customers receive a simple, non-transferable right to use the platform for the duration of the contractual relationship, within the scope of the selected plan.
(2) All content generated by the platform (memories, analyses, recommendations) may be freely used by customers for their own business purposes.
(3) The platform itself, its source code, design, algorithms, and underlying technology remain the property of the provider.
(4) The following are prohibited:
- reverse engineering, decompilation, or replication of the platform or parts thereof,
- resale or sublicensing of access,
- systematic extraction of data or content from the platform.
§8 Data and Memory Ownership
(1) Customers retain full ownership of all data they enter into or upload to the platform.
(2) AI-generated memories and analyses based on customer data belong to the customer.
(3) Upon termination of the contract, customers have the right to export their data and memories. After a transition period of 30 days following contract termination, customer data will be irreversibly deleted, unless statutory retention obligations apply.
(4) GrowthKit does not use customer data to develop or train its own AI models.
§9 AI-Generated Content
(1) GrowthKit uses AI systems (Anthropic Claude) for analysis, text generation, and recommendation generation.
(2) There is no guarantee that AI-generated content is factually correct, up to date, or error-free.
(3) Customers are responsible for reviewing AI-generated content before using it for business purposes.
(4) AI-generated content does not constitute legal, tax, or financial advice and does not replace professional consultation.
§10 Third-Party Integrations
(1) GrowthKit offers integrations with third-party providers (e.g. Pipedrive, Dreamdata). Customers are responsible for complying with the respective terms of service of those third-party providers.
(2) API keys from third-party providers are stored in encrypted form in the GrowthKit Credential Vault. GrowthKit assumes no liability for damages resulting from compromised API keys, unless the compromise was caused by GrowthKit.
(3) GrowthKit assumes no liability for the availability, accuracy, or completeness of data retrieved through third-party integrations.
§11 Availability and Support
(1) GrowthKit aims for an annual average availability of 99% but cannot guarantee this. Scheduled maintenance will be announced in advance where possible.
(2) Support is provided via email at [email protected]. Response times vary depending on the plan.
(3) GrowthKit assumes no liability for outages caused by third-party providers (Supabase, Anthropic, Stripe, Cloudflare).
§12 Feedback and User Content
(1) If customers submit feedback, suggestions, or reviews, the provider may use these for product development, provided no personal data is involved.
(2) Users must not submit or store unlawful, offensive, or copyright-infringing content in the platform or its memory system.
§13 Liability
(1) The provider is liable without limitation for intent, gross negligence, and injury to life, body, or health.
(2) In cases of simple negligence, the provider is liable only for foreseeable, contract-typical damages arising from the breach of material contractual obligations (cardinal obligations).
(3) No liability for lost profits, indirect damages, consequential damages, or data loss, to the extent permitted by law.
(4) Total liability is limited to the amount the customer has paid for the service in the 12 months preceding the event giving rise to the claim.
(5) The provider is not liable for business decisions made on the basis of AI-generated content.
§14 Data Protection
The processing of personal data is governed by the Privacy Policy at growthkit.tools/privacy.
§15 Final Provisions
(1) Amendments and additions to these Terms of Service must be made in text form.
(2) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(3) The place of jurisdiction for business customers is Berlin.
(4) Should any provision be or become invalid, the validity of the remaining provisions shall remain unaffected.
(5) The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. GrowthKit is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
